These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and In Home Displays Ltd., the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately. These terms and conditions may be updated at any time.

In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by In Home Displays Ltd. and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to In Home Displays Ltd. and accessing the Website in connection with the provision of such services.

In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission

  4. In Home Displays Ltd. reserves the right to alter, suspend or discontinue any part (or the whole) of the Website including, but not limited to, any products and/or services available. SmartView/SmartXtend Products

  1. When you purchase items in these ranges from us, there is a need to verify certain information in order to connect your device to your Smart Meter(s)/Communications Hub, as outlined in our Consent Statement in Clause 21 below.
  2. This evidence will be retained in a secure storage facility managed by In Home Displays Ltd. for the minimum period required. The storage facility will be restricted to access by limited, approved personal of In Home Displays Ltd. and any modification of these documents, once the Consent process has completed, will be denied through controls of this storage facility.
  3. You must not knowingly submit fraudulent data or upload fraudulent documents as proof of consent.
  4. Compatible smart meters are required for these devices to connect and display data. SmartView products are compatible with SMETS2 meters. SmartXtend products will function with SMETS1 or SMETS2 meters.
  5. These products can only be used in the location and with the meters verified at the time of purchase. Should you subsequently move home, please contact us at contact@ihdl.co.uk or see our FAQs for more information at www.in-home-displays.co.uk.
  6. SmartViewPro and SmartXtendPro devices have the option to link to our Fuuli app, available on the App store or Google Play store. If you opt to download and use this app, it is implicit that you give consent for data supplied from your smart meter(s) to be displayed.
  7. Should you wish to withdraw consent at any time, please contact us at contact@ihdl.co.uk. Please note that we are required to retain consent evidence gathered at the time of joining your devices for minimum period of 4 years from the date of withdrawal/expiry of consent.
  8. If consent is withdrawn, any devices within the n3rgy system will be unjoined from your network and will no longer function. Should you subsequently wish to reconnect devices, we will need to repeat the consent process. A reconnection service charge may be payable.
  9. We will contact you when your consent is due for renewal. Please ensure you notify us of any change of e-mail address so we can update our records.

Modifications to the Service and Prices

  1. Prices for our products are subject to change without notice.
  2. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
  3. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Warranty

  1. Our products are warranted to be free from defect in materials or workmanship for a period of 12 months from the date of purchase
  2. In Home Displays Ltd are not be liable in respect of any losses arising out of events beyond our reasonable control, for example (but not limited to) damage caused by misuse, abuse, accidents, or the use of incorrect power adapters being used with the product.
  3. Batteries (where supplied) are not covered under warranty. Please note our devices are designed to be powered from a standard UK 3 pin wall socket. SmartView products should be powered using the SmartAdapter provided. Batteries (if supplied) are intended for back-up purposes only for when Prepayment customer needs to enter in a UTRN or enable electricity supply where credit has been exhausted or disabled. Battery power can be used temporarily to identify device/appliance usage around the home.

Limitation of Liability

  1. Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (c) limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.
  2. We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.
  3. To the maximum extent permitted by law, In Home Displays Ltd. accepts no liability for any of the following:
    • any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;
    • loss or corruption of any data, database or software;
    • any special, indirect or consequential loss or damage.

General

  1. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.
  2. These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.
  3. These terms and conditions, together with the Privacy Policy and Consent Policy, contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.
  4. The Contract (Third Party Rights) (Scotland) Act 2017 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions.

If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.
  6. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.
  7. This Agreement shall be governed by and interpreted according to the law of Scotland and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the Scottish courts.
